1. Introduction
These Terms of Service ("Terms") govern your access to and use of hypertone, including our website, app, public API, and related services. By creating an account, using the service, or accessing hypertone in any way, you agree to these Terms.
If you do not agree to these Terms, do not use hypertone.
2. What hypertone Does
hypertone helps users turn existing website and brand content into marketing assets. This includes scraping submitted URLs, capturing screenshots, extracting content and images, generating templates, and producing rendered image and video outputs.
Some features also use AI providers to generate templates or edited images from your prompts, reference material, and workspace data.
3. Accounts and Access
You are responsible for all activity that occurs under your account, including activity by team members, scripts, and API clients using your credentials or tokens.
- You must provide accurate account information and keep it up to date.
- You must keep your sign-in methods, session access, and API tokens secure.
- You may not share access in a way that bypasses intended account, property, or API restrictions.
- You may not create multiple accounts to collect repeated signup credits, avoid limits, or otherwise abuse free-tier access.
4. Acceptable Use
You may use hypertone only for lawful, authorized, and legitimate business or creative purposes. You may not use the service to create, process, upload, publish, or distribute content that we reasonably determine is prohibited, abusive, dangerous, or unlawful.
Prohibited use includes, without limitation:
- Sexually explicit, pornographic, or otherwise NSFW content
- Graphic violence, gore, self-harm, or content promoting physical harm
- Deepfakes, deceptive synthetic media, or content intended to impersonate a real person, brand, or event in a misleading way
- Political persuasion, campaign materials, manipulative political messaging, or other political content we decide not to support
- Harassment, hate speech, threats, exploitation, or discriminatory abuse
- Fraud, impersonation, deception, spam, or misleading advertising
- Content that infringes privacy, publicity, copyright, trademark, or other rights
- Malware, phishing, credential theft, scraping abuse, or other security misuse
- Using hypertone to process content you do not have the right to use
We may remove content, suspend features, revoke API access, or terminate accounts if we believe your use violates these Terms or creates legal, safety, or reputational risk.
5. Submitted Content and Permissions
You represent that you have all rights, permissions, and authority needed to submit URLs, upload assets, generate outputs, and use the resulting materials through hypertone.
By using hypertone to create renders or other outputs, you agree that you have the necessary rights to the source content, uploaded assets, branding, and other material you use in that workflow.
You remain responsible for the legality, accuracy, and appropriateness of the content you submit and for how you use any output generated by the service.
6. Credits, Billing, and Refunds
hypertone uses a credit-based billing model. Some accounts may receive initial signup credits. Additional credits can be purchased through our billing flow.
- Different features may consume different numbers of credits.
- Renders may be blocked if your account does not have enough credits.
- AI image generation may deduct credits up front and refund them automatically if the generation fails.
- Except where required by law, credit purchases are non-refundable, including unused credits.
- Credit grants, promotional credits, or abuse-prevention adjustments may be changed, revoked, or denied at our discretion.

7. API and Rate Limits
If you use hypertone through the API, scripts, or automated workflows, you must follow any limits we apply to protect the service.
- API rate limits, request throttles, and concurrency limits may apply at any time.
- We may slow, reject, or block requests that exceed our limits or that appear abusive, unstable, or harmful to the platform.
- You may not attempt to bypass limits by rotating tokens, accounts, IPs, or other identifiers.
8. Service Availability and Changes
hypertone is an evolving service. We may add, remove, suspend, or change features, pricing, limits, models, integrations, and availability at any time.
We do not guarantee uninterrupted operation, permanent feature availability, or that every output will be accurate, complete, brand-safe, or fit for your intended use.
9. Intellectual Property
hypertone and its software, branding, interface, and service materials are owned by us or our licensors and are protected by applicable intellectual property laws.
Except as expressly allowed by law or these Terms, you may not copy, reverse engineer, resell, sublicense, or exploit the service itself without our permission.
10. Suspension and Termination
We may suspend or terminate your access, remove content, revoke tokens, or restrict features immediately if we believe you violated these Terms, abused the service, created risk for other users, or exposed hypertone to legal or operational harm.
You may stop using hypertone at any time. You may also delete your account from the app, subject to any required retention or legal obligations described in our privacy policy.
11. Disclaimers and Liability Limits
hypertone is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
To the fullest extent permitted by law, hypertone will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising out of or related to your use of the service.
12. Changes to These Terms
We may update these Terms from time to time. If we do, we will post the updated version on this page and revise the effective date above. Your continued use of hypertone after the updated Terms take effect means you accept the revised Terms.
